This Privacy Policy describes how Playlab (“Playlab, “we”, “our,” or “us”) handles Personal Information that we collect when you use our website and services ( “Services”). Any student data collected is used only for educational purposes at the direction of an educator, school, educational program, or a parent or guardian.

Playlab is designed for Educators, Students, and Educational Institutions, and as such, we adhere to applicable federal student privacy laws, including the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).

As a nonprofit, we are especially committed to protecting your privacy and handling any Personal Information we obtain from you with care and respect. This policy details that commitment.

By using Playlab and agreeing to our Terms, you are also agreeing to the contents of this privacy policy.

**1. **What Personal Information Does Playlab Collect?

We collect information that alone or in combination with other information in our possession could be used to identify you (“Personal Information”) as follows:

  • Account Information: When you create an account with us, we will collect information associated with your account, including your name, contact information, account credentials, and when relevant, payment card information and transaction history, (collectively, “Account Information”).

  • User Content: When you use Playlab, we may collect Personal Information that is included in your prompts, file uploads, responses generated on Playlab, and any feedback that you provide (“Content”). This data may be collected when a user creates or uses a tool on Playlab.

  • Communication Information: If you communicate with us, we may collect your name, contact information, and the contents of any messages you send (“Communication Information”).

  • Usage Data: We collect information about how you interact with Playlab, such as the features you use, the time you spend on the platform, the device you use to access Playlab, and other information affiliated with your IP address (e.g. time zone, country, dates and times of access).

  • Student Data: We collect information about students provided by the educational institution, educators, or students themselves. This may include student names, grades, and school-related performance data.

  • Cookies: We use cookies to operate and administer our Services, and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. You can set your browser to accept all cookies, to reject all cookies, or to notify you whenever a cookie is offered so that you can decide each time whether to accept it. However, refusing a cookie may in some cases preclude you from using, or negatively affect the display or function of, a website or certain areas or features of a website.   • Analytics: We may use a variety of online analytics products that use cookies to help us analyze how users use our Services and enhance your experience when you use the Services.

**A note about accuracy: **

Tools built on Large Language Models like Playlab generate responses by reading a user's request and then predicting the next most likely words that might appear in a response to that request. In some cases, the most likely next words may not be the most factually accurate ones. For this reason, you should not rely on the factual accuracy of output from models provided by Playlab. If you notice that Playlab output contains factually inaccurate personal information about you and you would like us to correct the inaccuracy, you may submit a correction request to dsar@playlab.ai. Given the technical complexity of how models provided through Playlab work, we may not be able to correct the inaccuracy. In that case, you may request that we remove your personal information from Playlab's output by contacting us at dsar@playlab.ai.

2. How We Use Personal Information

**We use the information we collect to: **

  • Improve Playlab, including personalizing your experience where possible
  • Communicate with you;
  • Prevent fraud, criminal activity, or misuses of Playlab, and to ensure the security of our IT systems, architecture, and networks
  • Comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.
  • Academic and Scientific Research: We may de-identify and aggregate Personal Information collected through Playlab to support scientific and academic research and to advance educational AI. For example, we might use this data to better understand how educators and students use AI to support learning. Or we might use this de-identified data to train educational AI models.

What Are The Legal Grounds For Processing Your Personal Information?

If you are located in the European Economic Area, the United Kingdom or Switzerland, we only process your Personal Information based on a valid legal ground. A “legal ground” is a reason that justifies our use of your Personal Information. We may use different legal grounds, such as:

  • You have consented to the use of your Personal Information, for example, to receive electronic marketing communications;
  • We need your Personal Information to provide our services, including for account registration, to respond to your inquiries, or for customer support;
  • We have a legal obligation to use your Personal Information; or
  • We or a third party have a legitimate interest in using your Personal Information. In particular, we have a legitimate interest in using your Personal Information to analyze and share your aggregated or de-identified information for research purposes, to analyze and enhance your learning experience on the Playlab Website and otherwise ensure and improve the safety, security, and performance of the Playlab Website. We only rely on our or a third party’s legitimate interests to process your Personal Information when these interests are not overridden by your rights and interests.

3. How We Share Your Information

We do not sell or rent your personal information to third parties. We may share your information in the following circumstances:

  • Service Providers that help us operate and maintain our Service, such as hosting providers, analytics, and security services. These providers are required to protect your information and use it only for the purposes for which it was disclosed.
  • Academic and Scientific Research: We may share de-identified and aggregate data with researchers and academic institutions to support research on Artificial Intelligence and education.
  • Legal Compliance: If required to do so by law or in the good faith belief that such action is appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, such as school, school districts, and law enforcement, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.
  • Business Transfers: If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

4. Your Rights

Depending on location, individuals may have certain statutory rights in relation to their Personal Information. For example, you may have the right to access, delete, correct, or transfer your Personal Information. You can exercise some of these rights through your Playlab account or by emailing dsar@playlab.ai.

California Privacy Rights

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) to access and delete your personal information. To exercise your right to access or delete your personal information, please contact us at dsar@playlab.ai.

We don't sell or share Personal Information as defined by the California Consumer Privacy Act. We also don't process sensitive personal information for the purposes of inferring characteristics about a consumer.

The following list provides additional information about how we disclose Personal Information. You can read more about the Personal Information we collect in “Personal information we collect” above, how we use Personal information in “How we use personal information” above, and how we retain personal information in “Security and Retention” below.

  • Category of Personal Information: Identifiers, such as your contact details. Disclosure of Personal Information: We disclose this information to our affiliates, vendors and service providers, law enforcement, and parties involved in Transactions.

If you are a data subject in the European Union (EU), European Economic Area (EEA), or the United Kingdom (UK), you have certain rights under the General Data Protection Regulation (GDPR) or UK GDPR, including the right to access, correct, delete, restrict the processing of, or object to the processing of your personal information. Additionally, if you are an EU/EEA or UK data subject, you have the right to lodge a complaint with your local data protection authority.

5. Student & Youth Privacy

FERPA & COPPA

We adhere to applicable federal student privacy laws in the United States, including the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).

Age Restrictions

Our Service is not directed to children under the age of 13. Playlab does not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to Playlab through the Service please email us at legal@playlab.ai.

We will investigate any notification and if appropriate, delete the Personal Information from our systems. If you are 13 or older, but under 18, you must have consent from your parent or guardian to use our Services.

Principles for Protecting Student Data

We’re dedicated to the following principles regarding gathering and protecting Student Data:

  • Student Data is exclusively used for purposes sanctioned by the student's educator, school, parent, or legal custodian.
  • We have established a Privacy Policy and a Platform that meet or surpass our obligations under COPPA, FERPA, and relevant state laws governing student privacy.
  • We do not display third-party advertisements to students utilizing the Platform.
  • We strictly prohibit the use or disclosure of Student Data for targeted promotions or marketing.
  • We advocate for schools and parents to maintain direct control over Student Data.
  • We implement top-tier security measures and encryption technologies to safeguard Student Data.
  • We are committed to continuously disclosing our data policies and practices in a transparent and comprehensible manner to our users and the broader public.
  • We are committed to not retaining Student Data longer than necessary for supporting the Platform's functions or legitimate business requirements.
  • We are committed to notifying our users and customers of major alterations to this Privacy Policy.

6. How we protect your data

We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.

We'll retain your Personal Information for only as long as we need in order to provide our Services to you, or for other legitimate purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations.

How long we retain Personal Information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.

Unless we have a separate agreement with you or your organization, we will remove PII within 12 months.

We may also anonymize or de-identify your Personal Information (so that it can no longer be associated with you) for research purposes, as described above, in which case we may use this information indefinitely without further notice to you. We will maintain and use de-identified information in anonymous or de-identified form and we will not attempt to reidentify the information.

Playlab is based in the United States. By accessing or using Playlab, or otherwise providing information to us, you understand that your information may be subject to processing, transfer, and storage in other locations. In the event that Playlab transfers your Personal Data from the European Economic Area ("EEA") to a country which is not subject to an adequacy decision by the European Commission, or which may not provide for the same level of data protection as the EEA, Playlab will ensure that the recipient of your PII offers an adequate level of protection. 7. Third Party Links

Playlab may contain links to other websites not operated or controlled by Playlab (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

**8. Changes to the privacy policy **

We may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to use our Service or providing us with Personal Information after we have posted an updated Privacy Policy, or notified you by other means, you consent to the revised Privacy Policy.
